  • Der Daytrader in mir sagt, erst einmal abwarten, bis sich der Kurs wieder beruhigt hat. Nachdem wir jetzt in Deutschland eine Kerze mit Riesendocht haben, glaube ich nicht, dass wir durchstarten. Vielleicht gibt es die Aktie später diese Woche auch wieder unter 40¤-Cent.


    Aber hört nicht auf mich, als Daytrader bin ich ein Amateur.

    Also für mich war das ruling der Startschuss für richtig dicke Kursgewinne. Bis 20:00 Uhr unserer Zeit werden nochmal die Angsthasen abgeschüttelt, und dann fängt der Börsentag noch mal von vorne an. Was da heute über pari gezahlt wurde war ja schon nicht mehr feierlich 8) ;D 8)

  • Patriot Scientific to Buy Back Outstanding Warrants

    CARLSBAD, Calif., July 24 /PRNewswire-FirstCall/ -- Patriot Scientific (OTC Bulletin Board: PTSC - News) today announced an agreement to repurchase all outstanding warrants for its common stock held by Lincoln Ventures, LLC. Lincoln Ventures and its affiliate Swartz Private Equity have been involved in several rounds of Patriot Scientific's funding since 1997. The agreement will retire all remaining warrants held by Lincoln and Swartz.

    CUPERTINO, Calif., Jul 24, 2007 (BUSINESS WIRE) -- The TPL Group today announced it has filed a plaintiff's motion to reschedule the Moore Microprocessor Patent(TM) (MMP) Portfolio infringement trial in the US District Court in the Eastern District of Texas from November 2007 to January 2008. The proposed rescheduling would allow additional discovery time for both plaintiffs and defendants to address the broad scope of infringing products manufactured by Toshiba, NEC and Matsushita/Panasonic/JVC.
    "As we continue to drive for a speedy trial in the Texas Court, we have come to realize along with the defendants that there is a need for the additional discovery time because of the extremely broad scope and pervasiveness of infringing end user products," asserted Dan Leckrone, Chairman of the TPL Group.

    Welcome back to the second of these irregular letters to you, our shareholders and partners. The past month has been a lively one for us with many significant events affecting Patriots cash position, our progress on short-term goals, and headway on our long-term goals.


    - For starters, our Markman ruling went very well. The June decision in the Eastern District of Texas was a complicated one and we're quite encouraged by the results.


    - So whats a "Markman hearing?" This is a formal process that takes place before the actual trial in many patent cases. The purpose is to help speed the trial along by sorting out in advance some of the details over terminology. If you ve ever read a patent you know that the language can be confusing and hard to follow. You don't want to waste time during the trial haggling over grammar, punctuation, and technical terminology so instead you work out those issues in advance. Both sides explain their interpretation of the patent language, and the judge decides which interpretation he believes is more accurate. Thats the interpretation that will be used in the actual trial.


    - I'm sure many of you saw our July 20 press release announcing that we've spun off DataSecurus. DataSecurus used to be called Multi-Domain Computers and was part of Holocom Networks, which we acquired back in 2006. I'm quite pleased with the deal and I wish the companys new management every success. Patriot will retain some equity in the business and John Burns (the president of Holocom) and I will serve on the company's board of directors. As DataSecurus grows and prospers we'll be in a position to share in the rewards.


    - You've probably also seen our July 24 press release announcing that we're retiring all the outstanding warrants held by Lincoln Ventures. This eliminates the last of the warrants Swartz and Lincoln have held since becoming long-term supporters and shareholders of Patriot Scientific. I'm grateful to them for the support they gave the company when times were bleak. Now that we're through that period, I felt it was time to retire any remaining obligations and put the final polish on our balance sheet.


    - In September I'll be speaking at the Arch Investment Conference in New York City. This will be a great opportunity to tell the Patriot Scientific story to institutional investors, analysts, and financial press. The conference will be webcast live and archived if you're interested in the presentations but can't attend in person.


    - Our licensing business took another step forward as Bull, the big French technology corporation, became the 20th licensee of our patent technology and the 18th in as many months. As always, we have every expectation of more licensees to come.


    - The nature of our licensing business requires a certain amount of privacy. I know that's frustrating for people who try to "read the tea leaves" and discern what we and our partners at TPL are doing on any given day. Certainly you all understand the need to conduct negotiations with potential licensees in confidence. Neither we nor they want to jeopardize a deal by being indiscreet. I'm sure that must be exasperating for those who feel they need a detailed play-by-play of our business negotiations, but that's not going to happen. Trust that we're working with our shareholders' best interests at heart.


    - We're close to appointing a new member to our board of directors. Im a big fan of this candidate and as soon as we've crossed all the t's we'll be happy to announce this valuable new addition to our team.

  • TPL Moves for Partial Judgment of Non-Infringement to Remove ARM as a Defendant, and Expedite Appeal from the Court's US Patent '584 "Instruction Groups" Claim


    CUPERTINO, Calif., Aug 08, 2007 (BUSINESS WIRE) -- In a further move to simplify and streamline the Moore Microprocessor Patent(TM) (MMP) Portfolio infringement trial in the US District Court in the Eastern District of Texas, The TPL Group today announced that it will ask the Court to enter a partial judgment of non-infringement as to certain products. Accordingly, the proposed partial judgment will:
    -- Stipulate that "instruction groups" claim elements of the accused claim of US Patent 5,784,584 (US '584) be deemed non-infringed for the purpose of this trial, based on the Court's claim interpretation, thereby allowing appeal from this claim interpretation ruling to be initiated immediately, rather than waiting until the end of trial.
    -- Stipulate that all accused ARM core families (ARM7, ARM9, ARM9E, ARM10E, ARM11), as well as the ARM Cortex microprocessor core family, are non-infringed under the Court's claim interpretation of "instruction groups," thereby removing ARM as an intervener in the Texas Court trial.
    Other moves initiated by The TPL Group to streamline the trial include:
    -- Using selected semiconductor devices to represent groups or families of chips and/or end user products so that the infringement evidence completed on one semiconductor device can be applied to many devices and/or end user products.
    -- Filing (and being granted on August 7, 2007) a motion for continuance of the trial to January 2008, thereby allowing 60 more days for additional discovery time needed for the extremely broad scope and pervasiveness of infringing end user products, thereby paving the way for very clear and succinct presentations to the jury during the upcoming trial.
    As a result of these moves by TPL, the trial will focus on two US patents in the MMP Portfolio (5,809,336 and 6,598,148 ), both of which encompass several claims against accused products manufactured by the defendants.
    "We expect our streamlining efforts to be very helpful to all involved, especially the Court and Jury in reaching their decision at the five-day trial," said Dan Leckrone, Chairman of The TPL Group. "We are confident we will prevail." He confirmed that TPL is pursuing damages for past infringement, penalties for willfulness, and an injunction prohibiting further operations in the US.
    Markman Ruling Perspective
    The June 18th Markman ruling broadly confirmed the strength of MMP claims including the very significant affirmation of US 5,809,336 as applied to both modern PLL-based and non PLL-based systems. Following the ruling, Leckrone asserted, "The ruling reflects well the skill of the Texas Court in dissecting and dealing with a very complex trial over the past 15 months." At that time he noted that there was a specific phrase that would require further scrutiny, and that phrase, disclosed today, is "instruction groups" as it relates to "multiple instruction fetch" techniques protected by US '584.
    Accelerating US '584 Appeal Process
    Commenting on the proposed partial judgment relative to US '584, Leckrone said, "We continue to believe that the claim construction for 'instruction groups' deserves more scrutiny than the Court could give it during the Markman hearing due to time and space constraints. While the proposed partial judgment we are seeking agrees to a judgment of non-infringement on this claim construction for the Texas Court trial, it will allow us to seek reversal of this interpretation in the US Court of Appeals for the Federal Circuit immediately. Otherwise, TPL would have had to wait for the end of the Texas Court trial in order to have the interpretation reviewed by the Court of Appeals."
    Despite the Texas Court trial, the sweeping scope of applications using MMP design techniques continues to encourage manufacturers of end user products from around the globe to become MMP licensees. Since January 2006, HP, Casio, Fujitsu, Sony, Nikon, Seiko Epson, Pentax, Olympus, Kenwood, Agilent, Lexmark, Schneider Electric, NEC Corporation, Funai Electric, SanDisk, Sharp Corporation, Nokia and Bull have all purchased MMP Portfolio licenses.

ARM (die dem Verfahren gegen die Japaner freiwillig beigetreten waren) sind nun wohl wieder draußen. Vermittlungsgespräche zwischen den Parteien (Mediation) sollen vom 25. bis 27. September stattfinden.

    CARLSBAD, Calif., Aug. 15 /PRNewswire-FirstCall/ -- Patriot Scientific Corporation (OTC Bulletin Board: PTSC - News) today filed its 10-K annual report for its fiscal year ending May 31, 2007. The company reported net income of $23.7 million, or $0.06 per diluted share, for the fiscal year 2007, as compared to net income of $28.7 million and $0.07 per diluted share for the previous fiscal year.
